Automatically Collected Information. When you visit the Hiccup Sites to place an order, browse, read, or download information, we may automatically collect and store the following types of non-personally identifiable information:

The type of operating system you are using.
The name of the domain and host from which you access the Internet.

Personal Information Provided Voluntarily by the User. You can use portions of the Hiccup Sites without providing any Personal Information. However, in order to take advantage of the full capabilities of the Hiccup Sites and to obtain access to, and use of, many of the features found on the Hiccup Sites, including placing orders for products offered for sale on the Hiccup Sites and receiving Hiccup email exclusives, you must provide certain Personal Information. You may also provide Personal Information when you participate in various services and offerings on the Hiccup Sites. Personal Information may include, without limitation:
Your name, mailing address, email address, telephone number, fax number, billing information, and credit card number and related information.

Use of Automatically Collected Information. Information collected automatically through the Hiccup Sites provides us with information regarding your use of the Hiccup Sites, including which pages are the most popular with Hiccup Sites users. That information also allows us to determine if the Hiccup Sites are working properly and to make changes to the Hiccup Sites to allow the user to have a better experience on the Hiccup Sites. We do not use that information to identify a particular user.
We may aggregate and use certain non-personally identifiable information for research or marketing purposes and may share, sell and rent or trade that information and statistical information derived therefrom with our marketing partners, advertisers, or other third parties.
Use of Non-personally Identifiable Information Provided Voluntarily by the User. By remaining opted-in to our email list, you are acknowledging that we may sell, rent, share, trade or otherwise provide or transfer your non-personally identifiable information such as demographic and occupational information to third parties. Such third parties may use such information for whatever purposes they wish or may transfer such information to other third parties.
Business Uses of Information. Hiccup uses Personal Information you provide to us for internal business purposes, such as (i) for verification at login as a registered user, if applicable; (ii) for marketing purposes; (iii) to contact you regarding the products or services that you have ordered or requested and to provide the same; (iv) for fulfillment of promotions, including but not limited to sweepstakes, contests or subscriptions that you have entered; (v) to process and ship orders; (vi) to send order and shipping confirmations; (vii) to provide customer service, respond to your requests and inquiries and enhance product and service offerings; (viii) to keep records regarding orders, returns and exchanges; (ix) to protect both you and us against error and fraud; (x) to send information, product and service alerts and exclusive offers; (xi) to record usage of the Hiccup Sites; (xii) to adjust the Hiccup Sites to your personal preferences; and (xiii) to customize advertising and Hiccup marketing information regarding our products and services. We may also exchange information, including Personal Information, with other companies and organizations for credit fraud protection and risk reduction.
Service Providers and Vendors. We may also share your Personal Information with certain third parties that perform services for Hiccup. Those third parties may host the Hiccup Sites, operate certain features on the Hiccup Sites, print or send mailings, provide marketing materials for the Hiccup Sites, authorize and process your payments, provide customer service, analyze data and assist in fulfilling your orders, send emails on Hiccup's behalf, or otherwise assist Hiccup with the operation of the Hiccup Sites. Those third parties are not authorized to use or disclose your Personal Information for any purpose other than to perform the services designated by Hiccup.
Business Transfers. Automatically collected information and your Personal Information may be transferred as an asset in connection with a merger or sale involving all or part of Hiccup or as part of a corporate reorganization, stock sale or other change of control.
Required Disclosures. Hiccup may also provide your Personal Information to a third party if Hiccup in good faith believes that access, use, preservation or disclosure is reasonably necessary to satisfy any applicable law, regulation, legal process or enforceable government request. For example, Hiccup may be required to disclose your Personal Information to respond to a subpoena, court order or other legal process.
5. Consent to Processing and Transfers of Information
Hiccup may transfer information that you send to us, including, without limitation, Personal Information, to recipients in countries that do not provide the same level of legal data protection as the country from which you access the Hiccup Sites. By using the Hiccup Sites, you consent to those transfers and to the processing by Hiccup of that information.
6. Notice for Parents
The Hiccup Sites are considered to be general audience Sites and are not to be used by children. Hiccup does not sell products that are intended for children and does not intend to collect Personal Information from individuals under the age of eighteen (18). If you are the parent or guardian of a child who has provided personal information to us, please inform us as provided under Section 12 below, and we will delete that Personal Information.
Cookies are pieces of information that a website transfers to an individual's hard drive to identify previous visitors to the Sites. Cookies are text files that can be rejected or deleted by you at any time. You may disable cookies using your Internet browser settings. However, by deleting or rejecting cookies, you may inhibit the user experience on the Hiccup Sites and other sites. For example, in order to complete online transactions, cookies must be accepted.

In addition, we currently contract with several online partners to help manage and optimize the Hiccup Sites. We use the services of a marketing company to help us measure the effectiveness of our advertising and how visitors use our sites. To do this, we use Web beacons and cookies provided by our marketing company on the Hiccup Sites. The type of information we collect includes which pages are visited, which products are put into the shopping cart, which orders enter the checkout process, which checkouts are executed with payment, etc. By supplementing our records, this information helps us learn things like what pages are most attractive to our visitors, which of our products most interest our customers, and what kinds of offers our customers like to see. Although our marketing company manages the information coming from our sites on our behalf, we control how that data may and may not be used. If you do not want to help us learn how to improve our sites, products, offers and marketing strategy, you can "opt-out" of our ability to analyze such data by contacting us (see Section 12).
9. Managing Your Information
You may "opt-out" of receiving future email or other communications from us by clicking the "unsubscribe" link at the bottom of any email that you receive from us, or by contacting us (see Section 12). Please note that removal of your Personal Information from our database or "opting-out" will not stop (i) marketing or advertising content that is ready to be mailed or is queued for transmission to you prior to the time when we can implement your request, or (ii) the use of your Personal Information by third parties with whom Hiccup may have already shared your information.

1. User Eligibility
The Hiccup Sites are available only to residents of the U.S. who are over the age of 18 and can form legally binding agreements. The products and services available on the Hiccup Sites are available only in the U.S. If you do not qualify, do not use the Hiccup Sites. In addition, you should only access the Hiccup Sites from within the United States or its territories, as access to the Hiccup Sites may be prohibited in countries outside the U.S. If you access the Hiccup Sites from outside the United States, you do so at your own risk and you are responsible for complying with the laws and regulations of your territory of access.
Special Note regarding Children: The Hiccup Sites are not intended for use by children under the age of 18 and, therefore, children under the age of 18 should not use the Hiccup Sites. Hiccup will comply with the Children's Online Privacy Protection Act and will not knowingly collect information from children under the age of 18. If you have children under the age of 18, you should not allow those children to use the Hiccup Sites and you should always monitor your children's use of the Internet. You should make your children aware that providing information about themselves over the Internet could be dangerous. Furthermore, parental control software is available to help you monitor your children's use of the Internet and to block your children's access to particular Internet sites.
2. Ownership and Permitted Use of Hiccup Sites and their Content
Hiccup provides the Hiccup Sites and their contents for your information, education and shopping pleasure. Please feel free to browse the Hiccup Sites. However, you should keep in mind that all of the information, content, and other material contained on the Hiccup Sites, including text, trademarks, written material, trade dress, catalogs, technical information and advertisements (all "Content") are the sole and exclusive property of Hiccup, its licensors, or other third parties. Such Content is protected under United States copyright and other laws and international treaty provisions and any unauthorized use by you of this Content may subject you to civil and criminal penalties. The ownership of all Content is retained by Hiccup. You may view, download, and print material displayed on the Hiccup Sites for your personal, non-commercial use only, provided you retain all copyright, trademark and other proprietary notices contained within the materials.
3. Certain Restrictions on Use
You may not:
distribute, retransmit, republish, reuse, repost, or use the contents of the Hiccup Sites for public or commercial purposes, without Hiccup's prior written permission;
alter, modify, frame, or "mirror" any content contained on the Hiccup Sites
use any data mining, robots, or similar data-gathering and extraction tools in connection with the Hiccup Sites;
remove or alter any copyright or other proprietary notices contained on the Content;
input or upload onto the Hiccup Sites any information or computer code that is intended to, or are likely to, damage, interfere with, alter, intercept or expropriate any data or system, or that infringes any intellectual property rights of Hiccup or any third party. Inappropriate uploads and inputs include, but are not limited to the following: Trojan horses, worms, time bombs, cancelbots and other unauthorized computer programming routines;
post or transmit any unlawful, threatening, obscene, libelous, or otherwise offensive material to the Hiccup Sites; or engage in any type of harassment activity via the Hiccup Sites.
4. Errors on the Hiccup Sites
Hiccup shall have no responsibility for errors of any kind on the Hiccup Sites or any Linked Website. Errors may include incorrect product and service descriptions, incorrect information regarding the availability of specific products, typographical errors and obsolete information, with the result that product and service descriptions, information regarding product availability, pricing information and the descriptions of promotional offers or other data may not be complete, current or accurate. In addition, errors may result when honoring a request or order placed by you if such request or order is based on incorrect information. Hiccup reserves the right to update or change information and correct any errors, inaccuracies, or other errors at any time.
A customer's sole and exclusive remedy if an item purchased by the customer from the Hiccup Sites does not fulfill the description set forth on the Hiccup Sites is to return the item, in an unused condition, to Hiccup for a refund of the purchase price and, in Hiccup's sole discretion, the shipping costs paid by customer. Customer, however, is responsible for shipping costs to return the unwanted item to Hiccup. Because actual colors and the "look and feel" you see on the Hiccup Sites will depend on your monitor and other technical factors, Hiccup cannot guarantee that any video display of any product information or other data will be accurate at any time.
The price of each product and service will only be confirmed by Hiccup upon the submission of an order by a customer. Prices provided on the Hiccup Sites are subject to change without notice and do not include shipping and handling or any applicable sales taxes or customs duties. In the event Hiccup discovers an error of any kind in pricing or product and service information, Hiccup reserves the right to, in Hiccup's sole discretion, (i) cancel any order related to such pricing or product and services information error, (ii) before shipping the product to or performing the service for customer, notify the customer of the error, and await the customer's instructions as to whether or not the customer wishes to proceed with the order in light of the error, or (iii) if a pricing error is involved, and a pricing error favors the customer, ship the product to customer at the incorrect price to the customer's benefit. Products and services described on the Hiccup Sites are available only while supplies last, and Hiccup reserves the right to discontinue the offering or sale of any product or service at any time, without notice.
5. Feedback and Submissions to the Hiccup Sites
Hiccup welcomes your comments regarding the products and services offered on the Hiccup Sites. From time to time you may be given the opportunity to respond to surveys and provide feedback regarding (i) the store located on a unique Hiccup Site and (ii) the Hiccup Sites in general. Please understand that any questions, comments, testimonials, feedback, responses to surveys, suggestions, or similar material disclosed, submitted or posted by you on the Hiccup Sites or through the feedback and survey opportunities offered by Hiccup or third parties will be considered non-confidential, non-proprietary and not personal to you nor anyone else and may be disseminated or used by Hiccup, its affiliates, and the third parties collecting the feedback and responses for any purpose including, but not limited to, developing, manufacturing or marketing products. In addition, by disclosing, submitting, or posting material to the Hiccup Sites, you grant to Hiccup a non-exclusive, worldwide, royalty-free, perpetual, irrevocable and fully sublicensable right to use, reproduce, modify, edit, publish, translate, rework distribute and display that material without compensation or acknowledgement of source. Therefore, you should not send Hiccup any creative ideas, original materials, suggestions, marketing plans or other information that you would like to remain confidential or for which you would like acknowledgement or compensation. Additional terms and conditions may apply in connection with certain types of submissions (e.g. testimonials, sweepstakes or contest entries). If applicable, these additional terms and conditions will be set forth where you submit the information or in a link adjacent to where you submit the information. You should review all additional terms and conditions carefully before submitting material to the Hiccup Sites.
By submitting material to the Hiccup Sites, you represent and warrant that you own or otherwise control the rights to your submission and that your submission does not contain software viruses, spiders, spybots, commercial solicitation, chain letters, mass mailings, or any form of spam. Furthermore, you understand that you may not use a false name, impersonate any person or entity, or otherwise mislead Hiccup as to the origin of any submission. You agree to indemnify Hiccup for all claims against it that arise from or are connected with your submission(s).
6. Disclaimer of Warranty
The Hiccup Sites, including all Content and the Content of any Linked Websites, are provided "as is" and "as available." AS TO THE Hiccup SITES, AND ANY LINKED WEBSITE, TO THE FULLEST EXTENT PERMITTED BY LAW, Hiccup EXPRESSLY DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.
Without limitation to the foregoing, Hiccup makes no warranty: (a) that there will be no interference with your enjoyment of the Hiccup Sites, Linked Websites, or Hiccup iOS Applications; (b) that the Content provided on the Hiccup Sites, Linked Websites, or Hiccup iOS Applications will fulfill any particular purpose or need; (c) that the Content provided on the Hiccup Sites, Linked Websites, or Hiccup iOS Applications is complete, reliable or accurate; (d) that any request or order placed by you to the Hiccup Sites, Linked Websites, or Hiccup iOS Applications will be honored according to your schedule or any stated schedule; (e) that the Hiccup Sites, Linked Websites, or Hiccup iOS Applications will otherwise meet any specifications, requirements or expectations; (f) that the Hiccup Sites, Linked Websites, or Hiccup iOS Applications will be uninterrupted, timely, secure or error free; (g) that the results obtained from use of the Hiccup Sites, Linked Websites, or Hiccup iOS Applications will be accurate and reliable; (h) that any errors in the content of the Hiccup Sites, Linked Websites, or Hiccup iOS Applications will be corrected; (i) that materials on the Hiccup Sites, Linked Websites, or Hiccup iOS Applications are appropriate or available for use in any particular location; or (j) that products or services displayed or referenced on the Hiccup Sites, Linked Websites, or iOS Applications are available for use in any particular location.

Hiccup reserves the right in its sole discretion, without prior notice and for any reason, including but not limited to unavailability of products, to deny an order or to refuse to fulfill an order in whole or in part. The Hiccup Sites may from time to time display links to other websites or resources sponsored by third parties as a convenience to you (such third party sites are known as "Linked Websites"). Hiccup has no control over Linked Websites and shall not be responsible for the availability of Linked Websites or their content. Access of Linked Websites is at your own risk. Third-party websites (and any websites to which they link) may also contain information that is inaccurate, incomplete, or outdated. Hiccup does not endorse or provide warranties of any kind as to the proprietors or content of any Linked Websites, including any linked website of any joint venture company or other company related to Hiccup.
